1. This limited period promotional initiative, namely Great Indian Festival 500 on 500 offer (“Promotion”) is provided by Amazon Pay (India) Private Limited (“Amazon”) and is made available on transactions undertaken on the website www.amazon.in or the corresponding mobile site or mobile application (collectively, “Amazon.in”), which is operated by Amazon Seller Services Private Limited (“ASSPL”).
2. This Promotion entitles certain benefits in respect of the transactions on the website or mobile application of BookMyShow (a “Merchant Website”) run by Big Tree Entertainment Pvt. Ltd (a “Merchant”) and in respect of Recharges and bill payments, Flights, Send money, Scan QR transactions on Amazon.in, in accordance with these Terms.
3. These Promotion terms (“Terms”) are in addition to Amazon.in Conditions of Use & Sale and Privacy Notice to which you agree to by using Amazon.in and the terms and conditions governing the eligible payment methods under this Promotion. To the extent the Conditions of Use & Sale and Privacy Notice are inconsistent with these Terms, these Terms shall prevail with respect to the Promotion.
4. This Promotion is valid from:
   • (i) 28th sept 12:00pm to 4th Oct 11:59:59 pm (“Promotion Period”) for select customers
5. During the Promotion Period, customer who:
   • (i) Purchases any product on Amazon.in (other than the Excluded Products) worth min INR 500; and
   • (ii) Makes payment for such transaction using any electronic payment method (not including pay-on-delivery payment method) on Amazon.in, will be entitled to the offers listed below that can be redeemed on Amazon.in and partner merchant site or app (“Offer”) as per these Terms as well as the terms and conditions applicable to the Offers.
6. Upon completion of the above transaction on Amazon.in, the customer will receive a link from Amazon Pay (India) Private Limited on the e-mail address or mobile number registered with the Amazon.in account of the customer, to collect the Offers of the customer along with the relevant details and guidelines to avail the Offer. Once a customer collects the Offers, the customer can avail the below mentioned benefits on Amazon.in or partner merchant website or app, subject to the minimum transaction amount
7. It is hereby clarified that, the maximum cashback benefit that a customer can avail under this Promotion using any or all of the Offers above is INR 500 on a cumulative basis.
8. The Offer entitles the customer to receive the benefit listed in the above table on the Merchant Website and on Amazon.in, if such customer:
   • (a) receives the Offer upon completion of steps mentioned above & collects the offer through the link provided to the customer on his registered e-mail address / mobile number
   • (b) the customer completes a transaction, in accordance with these Terms, on the Merchant Website and/or on Amazon.in (for the categories specified in the table above) during the Promotion Period;
   • (c) the customer complies with the purchase criteria, including the conditions of such purchase and the minimum transaction value (wherever applicable) mentioned above; and
   • (d) such customer pays for such transaction (on the Merchant Website or on Amazon.in) using the “Amazon Pay” payment option available on the Merchant Website or on Amazon.in, whichever applicable.
9. This Promotion is not available on purchase of Gift Card(s) (of any kind, whether or not Amazon branded, bank cards (such as RBL and ticket compliments gift card(s)), prepaid mobile recharges & bill payments, Kindle e-books, Kindle unlimited purchases, Amazon Prime memberships and Amazon Pay balance loads (“Excluded Products”).
10. The Offers will be available only up to October 10th post which all Offers will be deactivated and the customers will not be entitled to any benefit despite having received and collected the Offer.
11. Subject to the fulfillment of these terms and conditions, the cashback (as per these Terms) will be provided to the customer in the form of Amazon Gift Card(s), issued by QwikCilver Solutions Private Limited, redeemable as Amazon Pay balance associated with the Amazon.in account of the customer within 3 days of completing the transaction in accordance with these Terms. The use and redemption of Amazon Gift Card(s) and the use of Amazon Pay balance is subject to the applicable terms and conditions.
12. Under no circumstances, can any benefit under this Promotion be settled in cash in lieu thereof by Amazon, ASSPL or the Merchant.
13. Amazon is only responsible for providing and making available the Offer to the customers who successfully undertake the transaction on Amazon.in, and will have no responsibility for the non-fulfillment of the Offers by the Merchant Website.
14. The applicability or use of the Offers are subject to the terms posted on Amazon.in and to the terms posted by the Merchant on the Merchant Website, and Amazon assumes no responsibility in relation to the functioning of the Offers.
15. The transactions conducted on the Merchant Website and/or on Amazon.in will be subject to the terms (including the conditions of use etc.) notified by the Merchant or ASSPL, respectively.
16. The Offers will not be provided if the purchase transaction: (a) is cancelled (for any reason whatsoever) by the customer or the concerned seller or by ASSPL; or (b) is returned by the customer and in such a case, participation of the customer in the Promotion will be deemed withdrawn.
17. This Promotion will not be applicable if the customer or the Merchant (with respect to orders placed on Merchant Website) or ASSPL (with respect to orders placed on Amazon.in) cancels the order fully or partially and in such a case, participation of the customer in the Promotion will be deemed withdrawn. In such cases, if cashback has been received by the customer, amount of the cashback will be deducted from the transaction amount, at the time of refund to the customer (if any). For the avoidance of doubts, it is clarified that the mode of refund will be governed by the applicable terms hosted by the Merchant and ASSPL.
18. Any query / issue in relation to the transaction undertaken to avail the Offers will be addressed by Amazon and must be submitted by the customer through the customer service in his/her Amazon account on Help. Such queries / issues will be entertained by Amazon only till November 10th, 2019. Post this, Amazon will not entertain any correspondence or communication regarding the cashback from any person. Any queries pertaining to the transactions on the Merchant Website or applicability /use of Offer on the Merchant Website should be addressed to the Merchant.
19. By availing this Promotion, each customer releases from liability and holds harmless Amazon and its affiliates in relation to transactions on the Merchant Website, including inability to make a transaction on the Merchant Website. You agree that Amazon or any of its affiliates will not be liable or responsible for any loss or damage that you may suffer, directly or indirectly, in this connection, including use of the Offer.
20. Amazon reserves the right, at any time, without prior notice, without liability, and without assigning any reason whatsoever, to add/alter/modify/change or vary all of these Terms or to replace, wholly or in part, this Offer by another offer, whether similar to this Promotion or not.
21. This Promotion is governed by the laws of India and any disputes arising out of or in connection with this Promotion will be subject to the exclusive jurisdiction of the courts at Bangalore.
22. Amazon and/ or ASSPL reserves the right to disqualify a customer from the cashback / availability of the Offer if any fraudulent activity is identified as being carried out for the purpose of availing the Offer.
